Statutory Requirements and Bill of Rights

Comprehensive requirements for sober homes in Minnesota

Subdivision 1: Requirements

All sober homes must comply with applicable state laws and regulations and local ordinances related to maximum occupancy, fire safety, and sanitation. In addition, all sober homes must:

  • Maintain a supply of an opiate antagonist in the home in a conspicuous location
  • Have written policies regarding access to all prescribed medications
  • Have written policies regarding evictions
  • Return all property and medications to discharged persons and retain for 60 days
  • Document names and contact information for emergency contacts
  • Maintain contact information for emergency resources in the community
  • Have policies on staff qualifications and prohibition against fraternization
  • Permit residents to use FDA-approved pharmacotherapies for opioid use disorder
  • Have a fee schedule and refund policy
  • Have rules for residents
  • Have policies that promote resident participation in treatment and recovery supports
  • Have policies requiring abstinence from alcohol and illicit drugs
  • Distribute the sober home bill of rights

Subdivision 2: Bill of Rights

An individual living in a sober home has the right to:

  • Have access to an environment that supports recovery
  • Have access to an environment safe and free from alcohol and illicit drugs
  • Be free from physical and verbal abuse, neglect, and financial exploitation
  • Be treated with dignity and respect
  • Have personal, financial, and medical information kept private
  • Access community-based support services as needed
  • Be referred to appropriate services upon leaving the residence
  • Retain personal property that does not jeopardize safety or health
  • Assert rights without retaliation
  • Be provided with ombudsman contact information
  • Be fully informed of rights, responsibilities, and program policies
  • Not be required to perform services not included in usual resident expectations
